What is a draft Amendment?

    A modification to a planning document that has not been finalised.

    What is a Local Environmental Plan?

    A Local Environmental Plan (LEP) is a legal document that controls land use and development for a local government area.  It contains planning controls like land zoning, building height and building density (floor space ratio).

    What is Development Control Plan?

    A Development Control Plan (DCP) is a supplementary document that supports Council's LEPs.  The DCP contains specific controls to guide development, and achieve particular development outcomes.

    What does medium density housing mean?

    Medium-density housing  means residential developments that are at higher densities than standard low-density.  Medium density housing may consist of detached, semi-attached, attached (or multi-unit) housing and in some cases residential flat buildings.

    What are residential flat buildings?

    A residential flat building is a building containing 3 or more dwellings on one lot of land. Examples include apartments and units that have other dwellings above or below, often with shared access and common areas.

    Is Council going to change something? Will our area have high rise development like in Kogarah and Hurstville?

    This amendment does not change any key planning controls, rather removes inconsistencies and redundant controls in the Kogarah DCP (KDCP).

    Kogarah LEP (KLEP) was finalised in May 2017 before the KDCP could be updated, resulting in
    planning control inconsistencies between the two documents (specifically Part C2 Medium Density Housing of the KDCP) causing confusion in the building industry.

    E.g. On two blocks south of the railway line along Railway Parade, the KLEP specifies 33m building height; while the KDCP has the following height table that contradicts the KLEP. Therefore this table and any reference to building height need to be removed from the KDCP.

    The key aims of the draft amendment are:
    • to make the planning controls in KLEP and KDCP consistent and remove duplicity and redundancy
    • to comply with the State Government’s Apartment Design Guidelines and not duplicate those provisions.
    • to provide better design outcomes, interface controls and reduce impacts of the new development.

    How does the draft Amendment affect me?

    The Amendment to the KDCP does not change any key planning controls. You are being informed about this draft Amendment in accordance with the planning legislation.
