An amendment to the existing Planning Agreement for 1-5 Treacy Street, Hurstville (referred to as a Deed of Variation) is proposed. The proposed Deed of Variation is on public exhibition from Wednesday 20 September to Friday 20 October 2023.

Purpose of proposed Deed of Variation

The objective of the amendment to the Planning Agreement for 1-5 Treacy Street is to require a monetary contribution of $550,000 to Council for the release of the Developer from their obligation to dedicate the commercial space and fit out to the commercial space required under the existing Planning Agreement.

The Council at its Meeting on 28 August 2023 resolved to endorse the Deed of Variation to the Planning Agreement and that the documentation be placed on public notification. Also that following public exhibition that the Council enter into the Deed of Variation.


Existing Planning Agreement

The Planning Agreement for 1-5 Treacy Street, Hurstville between Council and GR Capital Group Pty Limited was executed on 14 March 2016 and relates to the construction of an 11 storey mixed use development under Development Application DA2014/1083 which is now constructed.

The Planning Agreement requires the Developer to provide public domain works, landscaping works, the dedication of land for footpath/future road widening and dedication of a commercial space and fitout of the space to Council.

The public domain works, landscaping works and dedication of the land for the footpath/future road widening have been provided however the commercial space has not been dedicated to Council.

Next Steps

At the end of the public notification period Council will review any submissions received. If no changes to the Deed of Variation are required, the Deed may be executed by the Council’s General Manager.
