Outcome
Georges River Council at its meeting on 25 October 2021 resolved to adopt the Georges River Council Local Infrastructure Contributions Plan 2021 (Section 7.11 and Section 7.12). The Plan comes into force on Wednesday 1 December 2021 and will repeal Council’s existing six Section 7.11 Plans and one Section 7.12 Plan on this date.
The Plan applies to land in the Georges River Local Government Area (LGA) and has been prepared to address anticipated demand for public facilities and services generated by new development up to 2036.
The Plan will enable Council and accredited certifiers to levy Section 7.11 contributions and Section 7.12 levies on development in the LGA towards the provision of public amenities and facilities.

Notice of Intention to Repeal Georges River Council’s Development Contributions Plans
This is a notice of intention to repeal the seven (7) existing Development Contributions Plans listed below:
- Kogarah Section 94 Development Contributions Plan No. 1 – Roads and Traffic
- Kogarah Section 94 Development Contributions Plan No. 5 – Open Space
- Kogarah Section 94 Development Contributions Plan No. 8 – Kogarah Town Centre
- Kogarah Section 94 Development Contributions Plan No. 9 – Kogarah Libraries
- Kogarah Section 94 Contributions Plan – Ramsgate Commercial Centre
- Hurstville Section 94 Development Contributions Plan 2012
- Georges River Council Section 94A Development Contributions Plan 2017
Georges River Council at its meeting on 25 October 2021 resolved that the existing development contributions plan (above) be repealed by the Georges River Council Local Infrastructure Contributions Plan 2021 (Section 7.11 and Section 7.12) and that this take effect by way of a public notice of repeal. The future repeal of these contributions plan will not affect the previous operation of the Plans or anything duly done under the Plans.
About
Council at its meeting on 28 June 2021 considered a report and resolved to exhibit the draft Georges River Council Local Infrastructure Contribution Plan 2021 – Section 7.11 and Section 7.12 (Alternatively, can be viewed on the top-right corner of this page) for a minimum of 28 days, in accordance with Section 28 of the Environmental Planning and Assessment Regulation 2000
Council with assistance from SGS Economics and Planning consultants have prepared the draft Georges River Council Local Infrastructure Contribution Plan 2021 – Section 7.11 and Section 7.12 (the ‘draft Contributions Plan’).
The primary purpose of the draft Contributions Plan is to:
Authorise consent authorities or private certifiers, when granting consent to development or issuing a complying development certificate, to impose a condition requiring contributions under section 7.11 or a levy under section 7.12 of the Environmental Planning and Assessment Act 1979. These contributions and levies are for the purpose of providing, extending or augmenting local infrastructure for the use of the community.
The other purposes of the draft Contributions Plan are to:
- provide the framework for the efficient and equitable determination, collection and management of contributions towards the provision of local infrastructure in the Georges River LGA; and
- ensure Council’s management of local infrastructure contributions complies with relevant legislation and practice notes; and
- demonstrate the cost of works, apportionment of those costs to new development and the contribution rates under this plan are reasonable; and
- establish the relationship between expected development and proposed local infrastructure; and
- ensure that developers make a reasonable contribution to the provision of local infrastructure required for development anticipated to occur up to 2036; and
- ensure that the existing community is not burdened by the cost of providing new infrastructure, either partly or fully, as a result of development in the area; and
- to allow the opportunity for local infrastructure, or the dedication of land at no cost to Council, to be provided by developers or landowners in lieu of paying a monetary contribution when it accords with Council objectives or outcomes.
The draft Contributions Plan includes a works schedule which details the local infrastructure that will be provided through the contributions and levies received through the plan. The broad categories of infrastructure that will be provided are:
- Open Space Facilities, including embellishment of existing open space and the acquisition of additional land for open space.
- Community facilities, including recreational facilities, libraries, community centres, and childcare facilities.
- Public Domain upgrades
- Traffic and transport facilities, including intersection and road upgrades as well as active transport upgrades.
