Consultation has concluded


An amendment to the existing VPA for 108, 112, 124 Forest Road and 1-3 Wright Street, Hurstville (referred to as the Bing Lee site) is proposed in relation to the timeframes for the dedication of the land.


Proposed Amendments to VPA:

The proposed amendments to the VPA are in respect of the dedication of land for the road widening on the Forest Road frontage of the Land, by changing the timeframe for the dedication from 5 years to 7 years from the gazettal of the Amending LEP.

The amended timeframes for the dedication are to change from by 28 February 2024 to by 28 February 2026.

Council, at its Meeting on 22 August 2022, resolved to endorse the amendments to the VPA and that the documentation be placed on public notification.


Existing VPA:

The VPA for 108, 112 and 124 Forest Road and 1 and 3 Wright Street, Hurstville between Council, Shanghai Lihua Hurstville Pty Ltd and SLH 108 Pty Ltd was executed on 26 March 2018.

The VPA relates to the development of the site enabled under the Planning Proposal PP2014/0004 and LEP Amendment No.13 to the Hurstville LEP 2012.

The VPA requires the developer to:

  1. pay a monetary contribution to Council of $3,775,750 for public infrastructure, amenities and services. This contribution was paid to Council on 18 March 2019; and
  2. dedicate approximately 196m2 along the Forest Road boundary, including land at Hudson Street and Wright Street intersections with Forest Road, for the “expansion and upgrade of public land” to enable road widening along the Forest Road frontage of the site. The land is to be dedicated:
  1. “within 3 months after the issue of the first Construction Certificate for the first Development Application for the Development; or
  2. within 5 years from the gazettal of the Instrument Change, whichever occurs first”

Hurstville LEP Amendment No.13, which rezoned the site to B4 Mixed Use and increased the building heights and FSR, was gazetted on 28 February 2019. The dedication of the land under point (b) above is therefore currently required by 28 February 2024.
